The following policies apply to Gauer Rental and all branches of Gauer Rental

GAUER RENTAL POLICIES & INFORMATION

INSURANCE PROTECTION: Gauer Rental provides no insurance protection for you or your company when you rent equipment. Once the rented item(s) leaves our facility, you the rentee are fully responsible for its safe return. We suggest that you contact your insurance agent to decide what you can do to provide for insurance on rental equipment to protect you. In case of damage, theft or disappearance, the rentee will be responsible for repairing or replacing the item with a like item or paying for the item in full. The rental will continue until the equipment is repaired, replaced or payment is received in full.

SECURING EQUIPMENT AT THE JOB SITE: Secure all rented equipment that you leave unattended at any job site. REMEMBER, you the rentee are responsible for returning the machine safely to our facility and are responsible for providing insurance coverage to protect you. If we deliver a machine to your job site, you are responsible for the machine upon its arrival at your site. Your phone call requesting us to pickup the machine does NOT end your responsibility for the machine. Your responsibility for the rented machine does not end until we pickup the equipment and you receive the paperwork.

PAYMENT TERMS & CREDIT TERMS:
1. Terms for rental are NET CASH.
2. Any customer not on open account will leave a deposit on each rental.
3. Deposits are refundable upon return of the rental machine.
4. No cash refunds on check deposits.
5. Credit extended for select accounts. Terms: NET 10 EOM open accounts.
6. Open accounts not up to date by the 30th of the month will be placed on a cash basis without notification.
7. Our rental equipment is not to leave the State of Ohio. Rental equipment is to be used within the Summit, Stark, Portage County areas. Any use of the equipment outside this area must be approved by a manager.
8. A 1 1/2 % service charge on all outstanding balances over 30 days will be added to your balance. 18% APR
9. We will take legal action against bad checks, past due accounts, and any other debts owed to our firm.

SALES TAX: Sales tax (Called use tax for rentals) is charged on all rentals, per the State of Ohio. Even when using rented tools on State, Federal or tax exempt jobs, rental is NOT exempt from State Sales Tax (Use Tax). There are now very few exemptions for sales tax on rentals. Please see your tax attorney/accountant & discuss this matter in detail, before removing tax from the rental. The State has taken a very aggressive collection policy on collecting sales tax on rentals.
TIME OUT & SHIFT OF OPERATIONS: We charge for all time our equipment is out. Rental rates are based on single shift operation. Additional charges will apply if a unit is used beyond single shift operation. Single shift operation means: 8 hrs./day 40 hrs./week, 160 hrs./4 weeks. Please watch the weather forecasts and plan your jobs accordingly as we do not offer rain days.

DELIVERY & PICKUP: Rates do NOT include delivery or pickup. We offer delivery and pickup service to established open account customers only. There is an additional charge for this service.

TIRE DAMAGE: The customer is responsible for tire damage, flats & tire repair.

FUELING: Our rental rates do NOT include fuel. See rental sales counter for information on our fueling policy per the specific machine.

EXCESSIVE/UNUSUAL WEAR & CLEANING CHARGE
1. Additional charges will apply if equipment has excessive or unusual wear and tear from a rental. We charge our normal shop rate plus parts.
2. Equipment returned damaged will be repaired by our shop or a mutually agreed upon repair station. If Gauer Rental makes repairs, we will charge our normal shop rate plus parts.
3. Equipment returned excessively dirty is charged a cleaning charge.

THINGS TO KNOW BEFORE YOU RENT EQUIPMENT
1. Gauer Rental rents equipment that can be potentially dangerous. To protect yourself and others, we require that you comply with all operating warnings & safety decals & all operating & safety instructions. You will also comply with all Federal, State & local laws, regulations, ordinances and codes. Gauer Rental rents and sells equipment to the professional user. Our equipment is to be operated by only properly trained, experienced, competent, prudent, qualified operators.
2. Gauer Rental does not make any warranty of merchantability or fitness for a particular purpose for a rented machine. Based solely on your own judgment, you, the rentee, will select the equipment needed to do your particular job properly and safely. Gauer Rental is not liable for damages or consequential damages caused by your selection of a machine. If our representatives suggests a particular machine, it is your responsibility, as a professional user, to confirm that this is the correct & safe equipment for your particular job site and job application. You the rentee, always make the final selection as to the type of equipment to use on a job.
3. If a machine malfunctions, becomes unsafe or is in disrepair, you will cease use of the rental machine immediately and immediately notify Gauer Rental. Gauer Rental will arrange for you to return the machine to repair or exchange.
4. You, the rentee, agree to hold Gauer Rental harmless from all claims, costs, expenses, damages or consequential damages, and liability resulting from the use, operation or storage of equipment during the term of the rental. Gauer Rental will not be liable for any loss, delay or damage resulting from defects in or inefficiency of our rental equipment. In no event will Gauer Rental have any liability for commercial loss, claims for labor or consequential damages of any type caused by our equipment.
5. You, your driver, or your competent employee are responsible for loading & unloading equipment. It is the rentee's responsibility to secure the load to your vehicle. Gauer employees are NOT responsible for loading or unloading or securing of rented equipment. Gauer Rental is not responsible for damage done during loading or unloading nor to machinery damaged because our rental equipment was NOT properly secured.
